General Terms and Conditions (GTC) of Estershop, Milanstrasse 4, 13505 Berlin

§ 1 Scope

1.1 These General Terms and Conditions (hereinafter "GTC") apply to all contracts concluded between Estershop (hereinafter "Seller") and the customer via the online shop at www.estershop.de.

1.2 Deviating conditions of the customer will not be recognized unless the seller expressly agrees to their validity in writing.

1.3 A consumer within the meaning of these GTC is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor their independent professional activity. An entrepreneur is any natural or legal person or a legal partnership that, when concluding a legal transaction, acts in the exercise of its commercial or independent professional activity.

§ 2 Conclusion of Contract

2.1 The product presentations in the online shop do not constitute a legally binding offer, but an invitation to place an order (invitatio ad offerendum).

2.2 By completing the ordering process, the customer submits a binding offer to purchase the goods contained in the shopping cart. By clicking the "Buy now" or "Order with obligation to pay" button, the customer submits a binding purchase offer.

2.3 The seller can accept the customer's offer within five days by: sending an order confirmation by e-mail, delivery of the goods, or request for payment. The contract is concluded upon receipt of the declaration of acceptance by the customer. If no acceptance occurs within this period, the offer is deemed rejected.

2.4 The contract language is German.

§ 3 Prices and Payment Terms

3.1 All prices are final prices and include the statutory value added tax. Additional delivery and shipping costs will be shown separately in the ordering process.

3.2 Payment is made at the customer's discretion using the payment methods offered in the shop (including PayPal, credit card, prepayment).

3.3 If the payment method "prepayment" is selected, the invoice amount must be transferred within 7 days of the conclusion of the contract.

3.4 The purchase price is due upon conclusion of the contract.

§ 4 Delivery and Shipping

4.1 Delivery will be made to the delivery address specified by the customer. Delivery restrictions are indicated on the website.

4.2 Unless otherwise stated, the delivery time is 3–5 working days within Germany. Different deadlines apply for international deliveries.

4.3 If the seller is prevented from delivery due to force majeure, strike, or other unforeseeable events, the delivery period will be extended accordingly. The customer will be informed immediately.

4.4 For consumers, the seller bears the shipping risk. For entrepreneurs, the risk passes to the carrier upon handover of the goods.

§ 5 Retention of Title

The delivered goods remain the property of the seller until full payment of the purchase price.

§ 6 Warranty

6.1 The statutory warranty rights apply. The warranty period for new goods for consumers is two years from delivery.

6.2 For entrepreneurs, the warranty period is one year from delivery. The warranty for used goods for entrepreneurs is excluded.

6.3 Obvious defects must be reported by the customer in writing within 14 days of delivery.

§ 7 Liability

7.1 The seller is liable without limitation for damages resulting from injury to life, body, or health, as well as for damages based on intent or gross negligence.

7.2 In the event of slight negligence in the breach of essential contractual obligations (cardinal obligations), liability is limited to the foreseeable damage typical for the contract.

7.3 Otherwise, the seller's liability is excluded.

7.4 The above limitations of liability do not apply if the seller has fraudulently concealed a defect or has given a guarantee for the quality of the goods.

§ 8 Right of Withdrawal and Exclusion of the Right of Withdrawal

8.1 Consumers have a statutory right of withdrawal. Further information can be found in the cancellation policy, which is part of these GTC and can be accessed at www.estershop.de/pages/widerrufsbelehrung.

8.2 The right of withdrawal and any right of return are excluded in accordance with § 312g para. 2 no. 1 BGB for goods that are not prefabricated and for the production of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer. This applies in particular to custom-made products, individual productions and customer-specifically configured products. A return or refund for such goods is excluded, unless the goods are defective within the meaning of the statutory warranty law.

§ 9 Dispute Resolution

9.2 We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

§ 10 Applicable Law and Place of Jurisdiction

10.1 The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this only applies insofar as mandatory protective provisions of the state in which the consumer has his habitual residence are not restricted thereby.

10.2 The place of jurisdiction for all disputes arising from contracts with merchants, legal entities under public law or special funds under public law is Berlin.

§ 11 Severability Clause

Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions remains unaffected. The statutory regulation shall take the place of the invalid provision.
